We as consumers still have a lot to learn about VoIP, as this technology is the new era of communication and is continuously being changed.

All VoIP service providers need to incorporate the protection, needs, and desires of its customers, as well as address security and dial up capability.

All VoIP service providers should invest in developing a proprietary patented technology that incorporates compression of data packets so that their VoIP can be used on dial up connections, as well as cable, satellite, and wireless.

1. Raphael means "God heals." Raphael heals physical, emotional and spiritual problems, and is sometimes known as the "divine physician." Raphael is believed to have healed Abraham after his circumcision. Raphael also healed Jacob when he dislocated his hip after wrestling with an angel.

2. Raphael is usually pictured holding a fish. This is the fish that Tobias caught while travelling to Media with Raphael. Raphael told him to cut out the fish's heart, liver and gall. Tobias, who did not know his travelling companion was Raphael, queried this strange request. The man told him that smoke made from the heart and liver would exorcise evil spirits, and the gall would restore the sight of someone with white film in his eyes. The trip was a success. Tobias was paid the money he was owed; he found a bride, and Raphael taught him how to use the smoke from the heart and liver to exorcise the demon inside his bride. On returning home, Raphael showed him how to use the gall to restore his father's eyesight. Only then did Raphael identify himself.

Sales People have an advantage as entrepreneurs

Zig Ziglar use to say in seminars and on tapes that nothing happens until someone sells something. I had never really understood how absolutely true that was until I got into franchising and saw how one franchise sale could add jobs to the economy, provide great service to a community and change the quality of life for the franchisee and their family. Sales people have an advantage over other folks in business. Our top performing franchisees were always the best sales people. Our toughest competitors, well their founders were great sales people too. To this point I would like to recommend a book to you, that makes this point:

"The Force" by David Dorsey.

This is an interesting book on the psychological turmoil associated with a sales team. How it transfers itself into the personal lives of team members and how companies like GE, Xerox and IBM develop team leaders and sales people to excel. Remember many great sales people have gone on to be great entrepreneurs. Ray Kroc, Ross Perot come to mind. It discusses the motivations and the inner drive of these people. We have many former sales people on our team doing very well. It appears that sales ability as it relates with people is a key ingredient in being a successful franchisee. Now we have successful franchisees, who are not sales people, however I have noticed a higher degree of success with people who have had sales experience.

This book should be read by those who do not want to be sold something by a sales person and by salespeople who think they are missing something or do not understand what their purpose is in their current job. Sales people who are quitting their job should read this book and those thinking of getting out of sales into a business should also read it and think about it.

Dont Get Eaten Alive!

If you don't have a grip on public relations, how your most important outside audiences behave really CAN eat you alive.

But that needn't happen, and for a simple reason: people like those who make up your key target audiences, act on their perception of the facts (like everybody else) which leads to predictable behavior, good or bad, about which something can be done.

The way to address target audience perceptions is to regularly monitor how members perceive your organization, especially any existing misconceptions or brewing problem areas. This is the monitoring phase.

Now, you isolate what is causing the perceptions you've uncovered, and the probable "fix" you will apply. Then you decide upon a realistic amount of behavior change you can achieve in an equally realistic time frame. You've just established your public relations goal.

Here, your public relations advisor moves into action by selecting one of three strategies available, to reach that goal: create a perception if none exists, change an existing perception, or reinforce it.

Then you prepare the persuasive messages you need to change perceptions among your key target audience. They should also address indirectly those problems or misconceptions that cropped up during your information gathering. The messages must also clearly identify what is really at issue, and be perceived as credible.

Now that you've done some information gathering while interacting with that key target public, you've set your public relations goal, strategy and prepared persuasive messages. How will you get those messages to the eyes and ears that need to hear and read them?

That's what communications tactics are for - the "beasts of burden" that deliver your carefully prepared, persuasive messages to your #1 external audience.

And there are scores of them including face-to-face meetings with adversaries, newspaper and radio interviews, op-ed placements, speeches, press releases, community meetings and many, many more.

From this point forward you're really in monitoring mode. You must interact again with members of that key, target audience, and keep an eye on print and broadcast media for references to your messages or viewpoints.

Because such indicators will reflect how local feelings about your organization are changing, you'll then have a chance, if needed, to adjust both the communications tactics and message content.

As time passes, you'll begin to notice increased awareness of your business and its role in the marketplace; a growing receptiveness to your messages by customers and others; increased public perception of the role your organization plays in its industry and in the community, as well as increasing numbers of prospects. At the same time, you'll look for indications that any misconceptions, or other problems you discovered, have been resolved.

Of course, how much progress you achieve will depend heavily upon your continued personal involvement in the activity, and the amount of effort you invest.

The good news is that when behaviors among those groups of people important to your organization are actually modified, the public relations effort is a success, and nobody gets eaten alive.

In public relations, there are no more happier, happy endings.

When Parents Disagree

Moms and dads, are there times you think that parenting would be easier if you didn't have to make family decisions? Having a partner that is not in agreement with your parenting ideas or discipline approaches is more than just frustrating. It can be a cause of division in even the best of relationships. Furthermore, how you handle your disagreements will have a direct impact on your relationship with your partner and with your children.

It would be great if every couple agreed on everything but that is an unlikely event. One partner may have been raised in a relaxed environment; another may have been raised in a very strict home. What is acceptable by one partner may be appalling to another. It is important to discuss with your partner what your parenting objectives are. Decide what values are important to both of you. You will find that some things are more important to you than to your partner and vice versa. Here are some steps you can do to work towards resolving parenting disagreements.

1. Discuss your parenting objectives. What is important to both of you? Sit down with your partner and decide what values are most important. Also what areas are not as important?

2. Talk about where your children are developmentally and what they are capable of understanding. Sometimes the reasons for parenting disputes are because one partner thinks that a child is capable of understanding something and the other disagrees. Knowing what your child's cognitive level is will help you to make better decisions. Do not compare your child to other children. You can use examples based on what they are capable of doing and not doing. For instance, if you ask them to get something out of their toy box, do they understand and go get it? If not expecting your child to be able to understand certain things may be unreasonable.

3. Find out what both of your parenting strengths and weaknesses are. Many times both parents want the same things for their kids. Compliment your partner on his/her strengths. Don't just point out your partner's flaws.

4. The majority of parenting disagreements are over discipline methods and when it is appropriate to discipline. One parent may think that spanking is the best method and the other may prefer time outs or something else. One of the most effective ways to resolve this issue is to talk about it. Find out the reasons why your partner feels the way he/she does. There are pros and cons to every form of parenting. Talk about why your partner thinks his/her discipline style is the better method. Sometimes talking about it will help you to see each other's point of view.

5. If the discussion gets heated, agree to disagree. Fighting about how to parent is only going to make the situation worse. Walk away, take a break and discuss it when you are not angry.

6. Plan ahead. Discuss problem situations you are having with your children. For instance, if you are having a problem with your child having temper tantrums, discuss how you think this should be handled. If you have a plan in action, it will be easier for both of you to follow each other's wishes.

7. Pick your battles. Some things you may never agree on. You don't have to agree on everything. Find the issues that are most important to you and work on resolving those first.

8. Do not argue about parenting in front of your children. This is easier said than done. The best way to handle a situation you don't agree with is not to interrupt but to wait till later and then discuss how you think it could have been handled differently.

9. Work on role modeling communication. If your children see that you communicate and problem solve together, they will grow up to do the same. Children often repeat patterns of their own parents. Look at your relationship and evaluate how you communicate. Is this the way you would like your children to communicate with their future partner?

10. Parenting and relationships are a growing process. The more you communicate the better parent/partner you will be. Learn from each other and listen to each other. Build on your parenting strengths and tackle your parenting weaknesses a little at a time. It won't happen over night but if you continue to discuss things with your partner calmly and positively you will become better parenting partners.

Spawning the Chinese Algae-Eater

I would like to say a few words about one of the bigger surprises I've had as an aquarist. A few years ago I was cleaning out a 50 gallon holding tank in which I kept fishes that were going to a new aquarium when the new aquarium was ready. I also used it for keeping fish I didn't know what else to do with. At this time this aquarium was home to twelve blue discus of about 10 cm, and four albino Chinese algae-eaters that were about 20 cm. The aquarium was overgrown with lots of C. Demersum since it had been neglected a little during the previous months. Now the time had come to clean this aquarium and try to weed out the jungle that had formed. To my big surprise I found a small (1.5 - 2cm) Chinese algae-eater fry. After looking around a little more I found a total of seven fry. I stopped the cleaning and left the aquarium as it was, since the water quality was good and I didn't want to change too much. I didn't see any reason to move the fry since they seemed big enough to !

be safe from the discus which I was moving to a 120 gallon Amazon tank in a few days anyway.

The fry survived and grew relatively fast on a diet of what they could find in the well-planted aquarium, and boiled lettuce. But I never got the parents to spawn again, and the fry themselves never spawned either. However I would like to say a few words about how the Chinese algae-eaters had been kept before the spawning, and which waters they spawned in, to see if I can help anyone else have success where I failed - to breed Chinese algae-eaters and figure out what triggers them to breed.

When I found the fry their parents had been in the holding tank for about 2-3 months. Before that I had kept them in a 50 gallon tank which was heavily circulated and contained very few plants. Temperature was 25?C/ 77?F. They were kept with clown loaches and various barbs. I've been wondering if the fact that they were kept in a heavily circulated aquarium and then moved to an aquarium with close to no circulation and warmer water (28?C/ 82?F) may have simulated a natural change in conditions that precedes spawning.

The breeding tank was as I said before, heavily planted, and had little or no circulation at all, due to the vegetation. The water was old and clean. Dh about 4. I can't say the exact water conditions as I don't know exactly when the spawning took place. However the water conditions had been relatively stable and it is reasonably safe to assume that the stated water conditions are correct.

The Chinese algae-eaters had been fed a varied diet which consisted mainly of boiled lettuce and broccoli, Hikari sinking algae wafers, and shrimps. They also ate the leftovers from the food I gave the barbs and loaches, which consisted mainly of different frozen foods.

Sexing the fishes I assume is simple. I believe it's done in the same way as Corydoras catfishes. Some fish have much broader bodies and I assume them to be females; males are more slender especially if well fed.

Getting the fish into spawning condition seems to be quite simple if they are fed a good diet. However the problem seems to be triggering them to spawn. As I said, I never got them to spawn again. Maybe you will have better luck!

Harassment of People in Debt by Creditors

Harassment

Harassment of people in debt by creditors or their agents is a criminal offence under the Administration of Justice Act 1970. It is often difficult to know what to do when you feel a creditor is not dealing with your account fairly. In order for you to identify what activities by your creditors may involve harassment and what can be done about the problem, this factsheet outlines:

SECTION 40 OF THE ADMINISTRATION OF JUSTICE ACT

S40 Punishment for unlawful harassment of debtors.

1. A person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under a contract he: harasses the other with demands for payment which, in respect of their frequency, or the manner or occasion of making any such demand, or of any threat or publicity by which any demand is accompanied, are calculated to subject him or members of his family or household to alarm, distress or humiliation; falsely represents, in relation to the money claimed, that criminal proceedings lie for failure to pay it; falsely represents himself to be authorised in some official capacity to claim or enforce payment; or utters a document falsely represented by him to have some official character, or purporting to have some official character which he know it has not.

2. A person may be guilty of an offence by virtue of sub-section (1) (a) above if he concerts with others in the taking of such actions as is described in that paragraph, notwithstanding that his own course of conduct does not by itself amount to harassment.

OFFICE OF FAIR TRADING CODE OF GUIDANCE

Many activities could count as harassment. It is important to note that anything done by a person which is reasonable when trying to recover a debt, is not considered to be harassment. Both the Office of Fair Trading and Trade Associations (run by the credit industry) have produced guidance on what activities may be considered harassment and should therefore be avoided by creditors. The following list is taken from the new Debt Collection Guidance for holders of consumer credit licenses.

Creditors are warned by the Office of Fair Trading under the Debt Collection Guidance that the following practices are "considered unfair":

IT IS UNFAIR TO COMMUNICATE, IN WHATEVER FORM, WITH CONSUMERS IN AN UNCLEAR, INACCURATE OR MISLEADING MANNER.

This includes:

Letters that look like court claims

Not making it clear who the company is or what their role is

Unhelpful legal language

Not giving balance statements about the debt when asked

Contacting you at unreasonable times even when asked not to

Asking you to contact them on premium rate phone numbers.

THOSE CONTACTING DEBTORS MUST NOT BE DECEITFUL BY MISREPRESENTING THEIR AUTHORITY AND/OR THE CORRECT LEGAL POSITION.

This includes:

Claiming to work for the court or be a bailiff

Implying action can be taken that is not legally possible such as implying they could take your property using a business name or logo that implies they are a government body

Implying that court action has been taken against you when it hasn't

Implying not paying your debt is a criminal offence

Threatening to take court action in England if you live in Scotland or the other way round.

PUTTING PRESSURE ON DEBTORS OR THIRD PARTIES IS CONSIDERED TO BE OPPRESSIVE.

This includes:

Contacting you too frequently

Pressurising you to sell property or take out more debt

Using more than one collection company at the same time or not telling you when your debt has been passed to another company

Pressurising you to pay in full or in large instalments you cannot afford

Making threatening gestures or statements

Ignoring disputes about whether you owe the money

Trying to embarrass you in public or threatening to tell a third party about your debts such as a neighbour or your family.

DEALINGS WITH DEBTORS ARE NOT TO BE DECEITFUL AND/OR UNFAIR.

Examples include:

Sending letters addressed to the occupier or discussing the debt with someone without knowing if they are you

Refusing to deal with an adviser acting on your behalf

Not accepting reasonable offers or passing on payments you make

Refusing to freeze action if you dispute the debt.

CHARGES SHOULD NOT BE LEVIED UNFAIRLY.

Examples include:

Claiming collection costs when the original credit agreement didn't allow this to happen and making you think you are legally liable for the costs

Not putting the specific amounts that can be added for collection costs in the original credit agreement

Adding unreasonable charges.

THOSE VISITING DEBTORS MUST NOT ACT IN AN UNCLEAR OR THREATENING MANNER.

Collectors should explain the reason for any visit and give you notice of the time and date they will call

They shouldn't visit if they know you are ill or vulnerable and if they find you are unwell or distressed they should leave

They should not come in if you do not want them to and should leave when you ask them to

They shouldn't visit you at work or somewhere like a hospital.

HOW TO DEAL WITH HARASSMENT BY YOUR CREDITORS

The first step is to write to a creditor and outline your concerns about the company's behaviour. Inform them that you are familiar with the terms of Section 40 of the Administration of Justice Act and ask that the creditor takes steps to avoid similar occurrences in the future.

Tell your creditors how you would prefer to be contacted and ask that they confirm their agreement to this. A letter at this stage may avoid the need to take further action against the company.

Tell them you are aware of the OFT Debt Collection Guidance and that you will consider making a complaint about their behaviour under the guidance.

It is usually difficult to persuade the police to prosecute in cases of harassment unless a more serious offence such as violence, fraud or blackmail is also involved. Normally complaints should be made to the trading standards/consumer protection department at your local council.

They should investigate whether an offence has been committed and whether prosecution is appropriate. The penalty is a fine of up to ?5,000 in the Magistrates Court. Also a conviction is likely to provide evidence that the creditor is no longer a fit and proper person to hold a consumer credit licence.

If Trading Standards will not act it may be worth contacting the Office of Fair Trading directly. The address is at the end of the factsheet. The OFT does not usually take up individual complaints but their Debt Collection Enforcement Team collects information that can be used to take action against creditors who can lose their consumer credit licence.

The creditor may be a member of a trade association with a code of practice. You could find out if your creditor is a member of a trade association and write to them with your complaint. A code of practice is not legally enforceable but the association may take some action against their members. Details of the main trade associations are at the end of the factsheet under "Useful Addresses".

OTHER OPTIONS

Another alternative is for you to pursue your own prosecution in the Magistrates Court. This could involve considerable cost so you need to obtain proper legal advice first.

BT have a new service called "Choose to Refuse" which might help if you are getting a lot of calls from an unpleasant creditor. You have to key in a pin number after a call. The caller will then get an automated message if you don't wish to take their call when they ring. The cost of the service is ?8.00 per quarter.

If you receive a telephone service from another provider, contact them and ask if they have a similar service.

You could refer to the Malicious Communications Act 1988. This deals with the sending of letters or articles for the purpose of causing "distress or anxiety". A person found guilty can be fined in the Magistrates Court.

To prosecute successfully, the letter or article sent would have to convey:-

A message which is indecent or grossly offensive

A threat; or information which is false and known or believed to be false by the sender.

The Criminal Justice Act & Public Order Act 1994 Section 4a makes it a criminal offence to cause Harassment, alarm or distress with intent by using threatening, abusive or insulting words or behaviour.

This can only be an offence if it happens in a public place not in your own home. The police would need to be contacted and prosecute for this offence.

The Protection from Harassment Act 1997 makes it a criminal offence to harass people and put people in fear of violence. The harassment must happen on at least 2 separate occasions. The police would have to agree to prosecute for this offence.
